FSSAI Mandates Update of Form IX Nominee Details and Introduces Auto-Approval for Non-Form C Modifications in FoSCoS
The Food Safety and Standards Authority of India (FSSAI) has issued a directive urging all Food Business Operators (FBOs) to ensure that the details of the Form IX nominee—the person responsible for compliance with food safety license conditions—are regularly updated. This measure comes in response to multiple instances where FBOs failed to inform the authorities when their nominated person changed or left the company. As a result, FSSAI has observed a lack of updated information on compliance officers in food businesses.
Regulatory Requirements for Updating Form IX Details
As per Rule 2.5.2 of the Food Safety and Standards Rules, 2011, it is mandatory for companies to intimate the Licensing Authority whenever there is a change in the nomination provided in Form IX.
Additionally, sub-regulation 2.1.9 (1) of the FSS (Licensing and Registration of Food Businesses) Regulations, 2011 requires FBOs to inform the Licensing Authority about any modifications or changes related to the product category, layout, expansion, closure, or any other material aspects of their business before implementing them.
Further, sub-regulation 2.1.2 (5) of the same regulations mandates that all license conditions as per Annexure 3 of Form B in Schedule 2 must be fulfilled. Condition No. 3 explicitly states that FBOs must inform the authorities about any changes or modifications in their business activities or content of the license.
Failure to provide updated information to FSSAI attracts penalties under Section 58 of the Food Safety and Standards Act, 2006.
Auto-Approval of Non-Form C Modifications in FoSCoS
To streamline the compliance process, FSSAI has introduced a new provision effective from February 12, 2025. The Food Safety Compliance System (FoSCoS) now allows modifications to Non-Form C details, including updates to Form IX nominee details, without requiring approval or scrutiny from the concerned authority. This change enables businesses to update their details without any fees and ensures faster processing.
Strict Compliance Required
All FBOs are directed to comply with this mandate to ensure that the Licensing Authority has up-to-date information on responsible personnel and any modifications in their business operations. Failing to update the relevant details may result in penalties or further regulatory action from FSSAI.
This move aims to enhance transparency, improve regulatory oversight, and ensure that businesses maintain the highest standards of food safety compliance.
